PRIVACY POLICY

1. SCOPE AND COVERED PROPERTIES

This Privacy Policy applies to Thunder Cloud Marketing, LLC (“we,” “our,” “us”) and governs data collection and usage across all properties, platforms, and services operated under our organization. This is a unified policy — one document covering every property to prevent conflicts between separate policies.

Covered Properties

  • Cosmic Park — cosmicpark.fun and all associated subdomains, including gaming applications on iOS and Android platforms, commerce websites, and related digital properties

  • The Board — Culture intelligence network and all associated platform modules, accessible via cosmicpark.fun/the-board and related URLs

  • The Haynes Index — Standalone AI intelligence product accessible at thehaynesindex.ai and theboardindex.ai

  • Board Intel — Natural language intelligence query layer within The Board platform

  • My Board — Personalized competitive intelligence environment within The Board platform

  • Local Board — Geo-specific intelligence module within The Board platform

  • Board+ / PATH — Subscription and experiential commerce layer

Any new property, product, or service launched under Thunder Cloud Marketing, LLC or its brands is automatically covered by this policy unless a separate, superseding policy is published for that property.

By using any of these properties, you consent to the data practices described in this policy.

 

2. GENERAL PROVISIONS

The following provisions apply to all covered properties.

2.1 Collection of Personal Information

We may collect personally identifiable information when you voluntarily provide it, including:

  • First and last name

  • Email address

  • Mailing address

  • Phone number

  • Payment and billing information (credit card, billing address)

  • Account credentials (username, hashed password)

You may be required to provide certain personal information when you: (a) register for an account; (b) subscribe to a paid service; (c) enter a sweepstakes or contest; (d) sign up for special offers; (e) send us an email; (f) submit payment information when purchasing products or services; or (g) participate in surveys or feedback programs.

We do not collect personal information unless you voluntarily provide it. We also may gather additional personal or non-personal information in the future as our services evolve.

2.2 Use of Personal Information

We collect and use your personal information to:

  • Operate and deliver the services you have requested

  • Communicate with you regarding services, products, and account activity

  • Process transactions and manage subscriptions

  • Inform you of other products or services available from our properties

  • Improve our services based on usage patterns and feedback

  • Comply with legal obligations

2.3 Sharing Information with Third Parties

Thunder Cloud Marketing, LLC does not sell, rent, or lease customer lists to third parties.

We may share data with trusted partners to help perform statistical analysis, send communications, provide customer support, process payments, or arrange for deliveries. All such third parties are prohibited from using your personal information except to provide these services, and they are required to maintain the confidentiality of your information.

We may disclose your personal information, without notice, if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to legal requirements or comply with legal process served on us or the site; (b) protect and defend our rights or property; and/or (c) act under exigent circumstances to protect the personal safety of users or the public.

2.4 Cookies and Tracking Technologies

Our properties may use cookies, web beacons, pixels, and similar tracking technologies to collect non-personal information about your browsing behavior, improve our services, and personalize your experience. You can manage cookie preferences through your browser settings. Some features of our properties may not function properly if cookies are disabled.

2.5 Right to Deletion

On receipt of a verifiable request from you, we will delete your personal information from our records and direct any service providers to do the same.

We may not be able to comply with deletion requests if the information is necessary to:

  • Complete a transaction or fulfill a contract between you and us

  • Detect security incidents or protect against malicious, deceptive, fraudulent, or illegal activity

  • Debug to identify and repair errors that impair existing intended functionality

  • Exercise free speech or another right provided by law

  • Comply with the California Electronic Communications Privacy Act

  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest, when deletion would render the research impossible, provided we have obtained your informed consent

  • Enable solely internal uses reasonably aligned with your expectations based on your relationship with us

  • Comply with an existing legal obligation

2.6 Right to Access and Portability

You have the right to request a copy of the personal information we hold about you. Upon verified request, we will provide this information in a commonly used, machine-readable format (CSV, JSON, or PDF) within 30 days.

2.7 Children Under Thirteen

We do not knowingly collect personally identifiable information from children under the age of thirteen. If you are under thirteen, you must ask your parent or guardian for permission to use our properties.

2.8 Email Communications

We may contact you via email for announcements, promotional offers, alerts, confirmations, surveys, and general communication. You may opt out of marketing or promotional communications at any time by clicking the Unsubscribe button in any email. Transactional emails related to your account or active subscriptions are not subject to opt-out.

2.9 Data Security

We rely on established third-party platform providers to host and deliver our services. These providers implement industry-standard security measures including encryption in transit and encryption at rest. We select providers that maintain commercially reasonable security practices and comply with applicable data protection standards. However, no method of electronic storage or transmission is 100% secure, and we cannot guarantee absolute security.

2.10 Data Retention

We retain personal information for as long as your account is active or as needed to provide you services. If you request account deletion, we will retain your information for a maximum of 90 days following the deletion request to allow for account recovery, after which it is permanently deleted. Certain information may be retained longer to comply with legal obligations, resolve disputes, or enforce agreements.

 

3. THE BOARD PLATFORM — ADDITIONAL PROVISIONS

The following provisions apply specifically to The Board, The Haynes Index, Board Intel, My Board, Local Board, and Board+ / PATH. These are in addition to the general provisions in Section 2.

3.1 AI-Assisted Intelligence Processing

The Board platform is powered by AI-assisted intelligence systems that process cultural signals across 15+ cultural verticals. When you interact with the platform, your usage may be processed by automated systems with human editorial review.

Specifically:

  • Intelligence Queries: Questions you submit through Board Intel or The Haynes Index are processed by AI systems to generate intelligence responses. Query content is used to deliver results and may be used in aggregated, anonymized form to improve intelligence accuracy.

  • Competitive Configurations: Brand and competitor selections you configure in My Board are stored in your account environment. This configuration data is isolated to your account and is not shared with other users or visible to competitors.

  • Vertical Preferences: Cultural vertical selections and engagement patterns are used to personalize your intelligence feed and may be used in aggregated, anonymized form to improve platform recommendations.

  • Dossier Intake: Information you provide through the Board Intel Dossier framework (identity, intent, sensitivity, and position data) is used exclusively to calibrate intelligence responses to your context. This data is stored in your account environment.

3.2 Multi-Tenant Data Architecture

The Board operates a multi-tenant architecture. This means:

  • Public Signal Corpus: Cultural signals processed by the platform are derived from publicly available sources. This data is shared across all users and does not contain personal information.

  • Tenant-Level Data: Your account-specific data — including competitive configurations, query history, vertical preferences, and Dossier inputs — is isolated to your account through database-level row-level security. Other users cannot access your tenant data.

3.3 Subscription and Payment Data

When you subscribe to paid features (Board Intel, Local Board, Board View, Board+ / PATH), we collect and process payment information through third-party payment processors. We do not store full credit card numbers on our servers. Payment processors are PCI DSS compliant and are contractually required to protect your payment information.

Subscription data we retain includes: subscription tier, billing cycle, payment history, and subscription status. This data is used to manage your account and is retained for the duration of your subscription plus 90 days.

3.4 Platform Disclosure Visibility

The Board platform maintains a persistent Platform Disclosure statement visible in the site header and footer on every page. This disclosure informs users that the platform is in public beta, that intelligence outputs are AI-assisted with human editorial review, and that information is provided for informational purposes only. The full disclosure statement is accessible at all times from any page on the platform.

3.5 Location Data (Local Board)

The Local Board module provides geo-specific cultural intelligence across designated cities and regions. If you use Local Board:

  • We may collect your general location (city/region level) based on IP address or your explicit location selection

  • We do not collect precise GPS coordinates unless you explicitly grant permission

  • Location data is used to deliver relevant local intelligence and is stored in your account environment

  • You can change your location selection at any time

3.6 Aggregated and Anonymized Data

We may use aggregated, anonymized data derived from platform usage to improve intelligence accuracy, develop new features, generate industry-level insights, and for research purposes. Aggregated data cannot be used to identify any individual user. This aggregated data may be shared with partners or published in reports without restriction, as it contains no personal information.

3.7 Third-Party Data Sources

The Board processes cultural signals from third-party data sources including public APIs, news services, and publicly available digital platforms. This processing involves publicly available information and does not involve the collection of personal information from third-party users. Our use of third-party APIs is governed by each provider’s terms of service.

 

4. YOUR RIGHTS

Depending on your jurisdiction, you may have the following rights regarding your personal information:

  • Access: Request a copy of the personal information we hold about you

  • Correction: Request correction of inaccurate personal information

  • Deletion: Request deletion of your personal information, subject to the exceptions in Section 2.5

  • Portability: Request your data in a machine-readable format (CSV, JSON, PDF)

  • Opt-Out: Opt out of marketing communications at any time

  • Restriction: Request restriction of processing in certain circumstances

To exercise any of these rights, submit a verifiable request to privacy@cosmicpark.fun. We will respond within 30 days.

 

5. CHANGES TO THIS POLICY

Thunder Cloud Marketing, LLC reserves the right to change this Privacy Policy from time to time. We will notify you of significant changes by: (a) sending a notice to the email address associated with your account; (b) placing a prominent notice on our properties; and/or (c) updating the “Effective Date” below.

Your continued use of our properties after such modifications constitutes your acknowledgment of the modified policy and agreement to be bound by it.
